1. Introduction

These Terms of Service (“Terms”) govern your access to and use of AnalysisGPT’s products, services, websites, and applications (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. 

“AnalysisGPT”, “we”, “our”, and “us” refers to the holding company SAI Group Ltd., the operator of the Service.

2. Eligibility & Accounts

• You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction; 13–16 in parts of the EU).
• You must provide accurate information when creating an account.
• You are responsible for keeping your credentials secure.
• Notify AnalysisGPT immediately of any unauthorized access or account compromise.

3. License & Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or internal business purposes.

You may not:

• Resell, sublicense, or redistribute the Service or its outputs without written consent.
• Reverse engineer, modify, or attempt to extract source code.
• Scrape, crawl, or perform automated data extraction.
• Upload unlawful, harmful, or infringing content.
• Use the Service to develop competing AI or analytics products.

Commercial use is permitted only under applicable paid plans.

4. Data Ownership, Rights & Privacy

4.1 Customer Data

You retain ownership of all data, content, and materials you submit (“Customer Data”).
You grant AnalysisGPT a worldwide, non-exclusive license to host, process, and transmit Customer Data as necessary to provide the Service.

4.2 AI-Generated Output

Unless prohibited by law:

• You own the output generated from your prompts, to the extent permitted by applicable IP laws.
• You are responsible for ensuring your use of outputs complies with all laws and third-party rights.
• You must not use outputs to create misleading, harmful, or unlawful content.  

4.3 Improvements & Anonymized Data

You agree that AnalysisGPT may use anonymized, aggregated, or de-identified data to:

• improve model performance,
• enhance security,
• optimize the Service 

We do not use identifiable Customer Data to train models unless separately agreed.

4.4 Privacy

We collect and process personal data in accordance with our Privacy Notice.
We honor data deletion requests within a reasonable timeframe, though anonymized data may be retained.

5. Subscriptions, Billing & Refunds

• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds: 
  • Monthly plans: refundable within 24 hours.
  • Annual plans: refundable within 72 hours.
  • EU/UK consumers: refundable within 14 days under local laws.
• Prices, features, and billing terms are listed on the AnalysisGPT website. 
• We reserve the right to update pricing with advance notice.  

6. Service Availability & Changes 

We aim for high availability but do not guarantee uninterrupted or error-free service.
We may modify, suspend, or discontinue parts of the Service at any time.

Material updates to these Terms will be communicated via email or product notifications at least 7 days before they take effect, unless required sooner for legal or security reasons.

Continued use of the Service after changes means acceptance of the updated Terms.

7. Intellectual Property

All rights in the Service — including software, models, features, content, and branding — belong to AnalysisGPT or its licensors. 
You may not use our trademarks, branding, or logos without permission.

8. Security & Compliance

AnalysisGPT maintains enterprise-grade security and compliance measures, including:

• SOC 2 Type II certification
• ISO/IEC 27001 certification
• ISO/IEC 42001 compliance
• GDPR adherence

You agree not to interfere with or circumvent our security measures.

9. Third-Party Integrations

The Service may integrate with third-party platforms such as Google, Microsoft, Apple, HubSpot, Shopify, or Stripe.
Your use of third-party services is governed by their respective terms.
AnalysisGPT is not responsible for failures, data issues, or outages caused by third-party platforms.

10. Beta Features

We may offer early-access or beta features.
These are provided “AS IS” without warranty and may be modified or discontinued at any time.
Use of beta features is at your own risk.

11. Limitation of Liability

The Service is provided “AS IS” and “AS AVAILABLE.”
To the maximum extent permitted by law:

• Our liability is limited to the fees you paid in the preceding 12 months.
• We are not liable for indirect, incidental, consequential, or punitive damages.

Nothing limits liability where prohibited by law.

12. Termination

We may suspend or terminate your access if you violate these Terms or use the Service unlawfully.
You may cancel at any time.
Upon termination, your right to use the Service ceases immediately.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.

Where permitted by law, disputes shall be resolved by binding arbitration under the rules of the London Court of International Arbitration (“LCIA”).
Arbitration will occur in London, United Kingdom, in English.

You may seek injunctive relief in courts of competent jurisdiction in cases involving misuse, data breaches, or IP infringement.

If you are a consumer in the UK/EU, you may have the right to bring disputes before your local courts.

14. Export Controls

You may not use the Service in violation of UK, US, or international export restrictions.

15. Miscellaneous

If any provision is found invalid, the remaining terms remain enforceable.
These Terms constitute the entire agreement between you and AnalysisGPT.
You may not assign rights or obligations without our written consent.
